Rate Schedule "90"

SCHEDULE FOR INTERRUPTING AND CURTAILING GAS SERVICE

 

AVAILABILITY

Rate Schedule "90" is applicable throughout the service area of Greater Dickson Gas Authority.

CHARACTER OF SERVICE

Gas service under Rate Schedule "90" is limited as to annual, monthly, and peak day volumes allowed and is subject to interruption and curtailment in the event that the gas supply of Greater Dickson Gas Authority is not adequate, due to emergency requirements or pipeline curtailments or supplier curtailments, to meet the demands of the customers of Greater Dickson Gas Authority. Greater Dickson Gas Authority shall promptly notify each affected customer of its curtailment period quantity entitlement and the curtailment period during which it will apply. Greater Dickson Gas Authority may modify the announced curtailment period quantity entitlement if conditions so require. Curtailment shall be based on the following priority of service categories:

(a)  Residential, small commercial (less than 50 dekatherms on a peak day),
        schools, hospitals, police protection, fire protection, sanitation facility, or
        correctional facility;

(b)  Essential agricultural requirements;

(c)  Large commercial requirements (50 dekatherms or more on a peak day), firm
        industrial requirements for plant protection, feedstock and process needs,
        and firm industrial sales up to 300 dekatherms per day;

(d)  All industrial requirements not specified in (b), (c), (e), (f), (g), (h), (i), or (j);

(e)  Firm industrial requirements for boiler fuel use at less than 3,000 dekatherms
        per day, but more than 1,500 dekatherms per day, where alternate fuel
        capabilities can meet such requirements.

(f)  Firm industrial requirements for large volume (3,000 dekatherms or more per
        day), boiler fuel use where alternate fuel capabilities can meet such
        requirements;

(g)  Interruptible requirements of more than 300 dekatherms per day but less than
        1,500 dekatherms per day, where alternate fuel capabilities can meet such
        requirements;

(h)  Interruptible requirements of intermediate volumes (from 1,500 dekatherms per
        day through 3,000 dekatherms per day), where alternate fuel capabilities can
        meet such requirements;

(i)  Interruptible requirements of more than 3,000 dekatherms per day, but less than
        10,000 dekatherms per day, where alternate fuel capabilities can meet such
        requirements;

(j)  Interruptible requirements of more than 10,000 dekatherms per day, where
        alternate fuel capabilities can meet such requirements.

Insofar as practical, service will be curtailed in accordance with the reverse order of priorities set forth above, beginning with interruptible service (j) and continuing as required. In the event of a short-term emergency curtailment caused by unforeseen supply reductions, force majeure conditions, or to correct or prevent limited distribution system failures within the service area, the above curtailment schedule may be modified or revised by Greater Dickson Gas Authority to accommodate actual emergency requirements.

Interruptible gas service is supplied to customers of Greater Dickson Gas Authority under Rate Schedules "50", "51", "55", "56", "75", and "76" and under any special contracts that may be approved by Greater Dickson Gas Authority from time to time. Except as may be otherwise determined by Greater Dickson Gas Authority in its sole discretion, periods of interruption shall generally be imposed on interruptible customers of Greater Dickson Gas Authority in the following order:

(a)  If the period of interruption is necessary due to an emergency or a capacity
        limitation on the gas distribution system of Greater Dickson Gas Authority,
        then the interruption of service to all interruptible customers of Greater
        Dickson Gas Authority shall be handled on a pro rata or other equitable basis
        as determined by Greater Dickson Gas Authority.

(b)  If the capacity limitation affects only a restricted geographic area of the
        distribution system of Greater Dickson Gas Authority, then only interruptible
        customers of Greater Dickson Gas Authority within the restricted area will
        have their service interrupted. The interruption of such customers shall be
        handled on a pro rata or other equitable basis as determined by Greater
        Dickson Gas Authority.

(c)  If the period of interruption is necessary due to a shortage of the normal gas
        supply of Greater Dickson Gas Authority, whether caused by a capacity
        limitation of connecting pipelines to Greater Dickson Gas Authority or by an
        actual shortage of gas, then:

(i)  The first service interrupted shall be Rate Schedule
        "75" and Rate Schedule "76" customers who are
        being provided service under Rate Schedule "50",
        Rate Schedule "51", Rate Schedule "55", or Rate
        Schedule "56".

(ii)  The second service interrupted shall be Rate
        Schedules "50", "51", "55", and "56" customers who
        have not heretofore been interrupted as provided
        above.

The interruption of such customers shall be handled on a pro rata or other equitable basis as determined by Greater Dickson Gas Authority.

(d)  If the period of interruption is necessary due to a lack of
        confirmation by any connecting pipeline of deliveries to any Rate
        Schedule "75" and/or Rate Schedule "76" customers, then only
        service to the affected Rate Schedule "75" and/or Rate Schedule
        "76" customers will be interrupted. Rate Schedule "75" and/or
        Rate Schedule "76" customers who are interrupted in such cases
        will be permitted to purchase gas in accordance with Rate
        Schedule "50", Rate Schedule "51", Rate Schedule "55", or Rate
        Schedule "56", as applicable, unless service under Rate Schedule
        "50", Rate Schedule "51", Rate Schedule "55", and/or Rate
        Schedule "56" is otherwise interrupted as outlined above.

Firm transportation gas service is supplied to customers of Greater Dickson Gas Authority under Rate Schedule "70" and Rate Schedule "71" and under any special contracts that may be approved by Greater Dickson Gas Authority from time to time. Periods of interruption shall be imposed on firm transportation customers of Greater Dickson Gas Authority as follows:

(a)  If the period of interruption is necessary due to a lack of
        confirmation by any connecting pipeline of deliveries
        to any Rate Schedule "70" and/or Rate Schedule "71"
        customers, then only service to the affected Rate
        Schedule "70" and/or Rate Schedule "71" customers
        will be interrupted. Rate Schedule "70" and/or Rate
        Schedule "71" customers who are interrupted in such
        cases will be permitted to purchase gas in
        accordance with Rate Schedule "60", Rate Schedule
        "61", Rate Schedule "65", or Rate Schedule "66", as
        applicable, if capacity on the distribution system of
        Greater Dickson Gas Authority and on the transporting
        pipeline is available and unless service under Rate
        Schedule "60", Rate Schedule "61", Rate Schedule
        "65", and/or Rate Schedule "66" is otherwise
        interrupted as outlined above.

Notwithstanding the provisions of the above paragraphs, Greater Dickson Gas Authority shall not be liable for any damages that may result to customers or any other person, firm, or corporation by reason of the limiting by Greater Dickson Gas Authority of annual, monthly, or peak day volumes or by curtailing service in accordance with the above order of priorities or in accordance with any other order of priorities which may be deemed practicable by Greater Dickson Gas Authority under existing conditions.

Greater Dickson Gas Authority will make every reasonable effort to deliver plant protection volumes to firm industrial and commercial customers having no standby fuel system sufficient to prevent damage to facilities or danger to personnel.

 

LIMITING FIRM GAS SERVICE

Contract or entitlement amounts as to annual, monthly, and peak day volumes are subject to change by Greater Dickson Gas Authority as supply conditions or customers’ consumption patterns warrant. Any quantity of gas exceeding specified contract or entitlement amounts taken by customer without the advance written approval of Greater Dickson Gas Authority will be subject to an unauthorized overrun penalty as described below.

 

UNAUTHORIZED OVERRUN PENALTY

If at any time, a customer exceeds specified contract or entitlement or if during any curtailment period, any affected customer takes, without the advance written approval of Greater Dickson Gas Authority, a volume of natural gas in excess of the curtailment period quantity entitlement applicable to such customer, said volume shall constitute an unauthorized overrun volume. For each therm of such unauthorized overrun volume taken by such customer, such customer shall pay to Greater Dickson Gas Authority a penalty of one dollar and fifty cents ($1.50) together with and in addition to the demand, commodity, penalty charges, and any other charges otherwise payable by such customer for the period in which said unauthorized overrun volume was taken.

The payment of a penalty for unauthorized overrun volumes shall not under any circumstances be considered as giving any such customer the right to take unauthorized overrun volumes; nor shall such payment be considered as a substitute for any other remedies available to Greater Dickson Gas Authority or any other customer against the offending customer for failure to adhere to its obligations under the provisions of this Rate Schedule "90" .This unauthorized overrun penalty does not apply to Public Housing Authorities, apartment buildings, or residential customers.

 

NOTICES

To the extent possible, Greater Dickson Gas Authority shall give customer at least a one hour notice of interruption before a period of interruption begins. A notice of interruption may be written or oral and shall be sufficient if given by Greater Dickson Gas Authority via telephone or in person to the person or persons designated from time to time by the customer as authorized to receive such notices, or by facsimile transmission to the telephone number designated from time to time by the customer, or if mailed or hand-delivered in writing to the customer’s premises. If a period of interruption involves only a reduction in the amount of gas being transported, the notice of interruption shall state the daily and/or hourly quantity of gas which customer may transport. A period of interruption shall continue in effect until Greater Dickson Gas Authority notifies customer that the period of interruption has terminated or until the time specified in the notice of interruption expires.

 

RULES AND REGULATIONS

This Rate Schedule "90" is subject to the Rules and Regulations of Greater Dickson Gas Authority which may from time to time be in effect.
